Privacy policy

Draft, pending legal review

This page is a draft. It has been prepared for review by legal counsel and has not been approved yet. It sets out how we intend to operate, and it is not legal advice to you or to anyone else.

If anything on this page differs from the quotation, the bill of lading or the signed agreement covering your shipment, that document governs. If you need our position on something confirmed before you ship, ask us in writing and we will confirm it in writing.

What this page covers

What personal information we collect, why we collect it, who we share it with, how long we keep it, how we protect it, and how you can see it, correct it or complain about how we handled it.

We are subject to the Personal Information Protection and Electronic Documents Act, the federal privacy law that applies to commercial activity in Ontario. This policy is written to follow it.

1. Who is accountable for your information

  1. The organization responsible for the personal information described here is the company named in the address below.
  2. We have designated an individual who is accountable for our compliance with this policy and with privacy law. We call that person our Privacy Officer.
  3. You can reach the Privacy Officer by email at the address below, or by writing to us at our business address. Put the word Privacy in the subject line so it is routed correctly.

We answer privacy requests in writing. If you would rather speak to someone, say so in your message and we will arrange it.

2. What we collect

We collect only what we need to quote, move and bill freight, and to run the company. In practice that is five groups of information.

Quote requests

When you ask us for a price, we collect your name, your company, your email address, your phone number if you give it, the pickup and delivery addresses, and what you told us about the freight: pieces, weight, dimensions, commodity and any special requirement.

Customers and contacts

For an account we hold billing and operational contact details, purchase order and reference numbers, and the account and credit information needed to invoice you and collect payment.

Shipment records

For every shipment we hold the pickup and delivery addresses, the contact at each end, the name and signature of the person who signs for the delivery, and photographs taken as proof of delivery. A photograph taken at a delivery can incidentally show a person or a vehicle, and that is personal information too.

Drivers and staff

We hold the employment records our people would expect us to hold, and we collect location data from the devices used to run a route. Where a device reports its position, that position is linked to the driver operating it, so it is personal information about that driver and it is treated as such in this policy. Drivers are told this in plain terms before they use the device, not only through this page.

Website use

Our servers record ordinary web request information: the IP address the request came from, the browser it came from, the pages requested and the time. Cookies are covered on our cookies and analytics page.

3. Why we collect it

  1. To quote a shipment and to answer your questions about one.
  2. To plan and run routes, to dispatch drivers, and to tell you where your freight is.
  3. To prove that a delivery happened, which is what the signature and the proof of delivery photographs are for.
  4. To invoice you, to collect payment, and to keep the accounting records the law requires us to keep.
  5. To investigate and settle claims for loss, damage or delay.
  6. To meet our obligations as a licensed for hire carrier, including record keeping obligations under Ontario and federal transportation law, and to investigate incidents and collisions.
  7. To keep people, equipment and freight safe.

Driver location data specifically

Location data is collected to dispatch and sequence work, to give customers accurate arrival information, to confirm that a stop was serviced, to support the safety of a driver working alone, and to investigate an incident or a disputed delivery. It is not collected to monitor a driver's private life, and it is not used for a purpose unconnected with running the work.

4. Consent

  1. We collect, use and disclose personal information with your knowledge and consent, except where the law allows or requires us to do otherwise.
  2. Sending us a quote request is your consent to us using what you sent to prepare a quote and to contact you about it.
  3. Signing for a delivery is part of the delivery record. We collect the signature to prove that the shipment arrived.
  4. You can withdraw consent, subject to legal and contractual restrictions and to reasonable notice. Tell us and we will explain what withdrawing means. In some cases it means we can no longer carry freight for you, because we cannot run a shipment without the addresses and contacts it needs.

5. Who we share it with

  1. Our own people, and only those who need it to do their work.
  2. Service providers who operate the systems we run on, send our email, process payments and keep our books. They act on our instructions, they are bound by contract to protect the information, and they may use it only to provide the service they provide to us.
  3. Another carrier or agent, where a shipment is interlined or a portion of a movement is subcontracted, limited to what that carrier needs to complete the movement.
  4. Insurers, adjusters and investigators, where there is a claim or an incident.
  5. Our professional advisers, under a duty of confidentiality.
  6. Government, regulators, law enforcement or a court, where the law requires or authorizes it.
  7. We do not sell personal information, and we do not share it for anyone's advertising.

Information held outside Canada

Some of our service providers may store or process information outside Canada. Where that happens, the information is subject to the laws of the country it is in, and may be accessible to the courts, law enforcement and national security authorities of that country. Ask us and we will tell you what we know about where a particular kind of record is held.

6. How long we keep it

  1. We keep personal information only as long as we need it for the purposes set out above, and for the minimum periods the law requires us to keep records, for example tax, transportation and employment records.
  2. Our systems delete records automatically once the retention period for that kind of record has passed. The deletion is a scheduled process, not something someone has to remember to do.
  3. We are still setting the retention period for each kind of record. Until those periods are published here, we keep records only for as long as the purposes above and the law require, and we do not keep them for longer because it is convenient.
  4. Information that is no longer needed is deleted or anonymized.

7. How we protect it

  1. Access is limited to the people who need the information to do their work, through individual accounts and role based permissions rather than shared logins.
  2. Information sent to and from this website and our portal travels over an encrypted connection.
  3. Systems are backed up, and paper records and devices are kept physically secure.
  4. Service providers are held to confidentiality and security obligations by contract.
  5. We review these safeguards as the business changes. No safeguard is perfect, and we do not claim otherwise.

8. Seeing and correcting your information

  1. You can ask us what personal information we hold about you, how we have used it and who we have disclosed it to. Write to the Privacy Officer at the address on this page.
  2. We respond within 30 days of receiving your request, as privacy law requires. If we need an extension the law allows, we will tell you before the 30 days are up and explain why.
  3. We may need to confirm your identity before we release anything, so that we do not disclose your information to someone else.
  4. We may have to withhold some information, for example where releasing it would reveal personal information about another person, where it is subject to solicitor client privilege, or where the law requires us to withhold it. If we withhold something we tell you that we have, and why.
  5. If information we hold about you is wrong, tell us and we will correct it. Where we have disclosed the wrong information to someone else, we will tell them about the correction where that is practical.
  6. We do not charge for a routine access request. If a request would cost something to fulfil, we tell you the cost before we do the work, and you can withdraw the request.

9. If something goes wrong

  1. If personal information we hold is lost, stolen or accessed by someone who should not have it, we investigate and contain it.
  2. Where a breach creates a real risk of significant harm to an individual, we report it to the Privacy Commissioner of Canada and we notify the individuals affected, as soon as feasible, as privacy law requires.
  3. We keep a record of every breach of security safeguards, whether or not it was reportable, for 24 months.
  4. Where notifying another organization could reduce the harm, we notify them too.

10. Complaints

  1. If you think we have mishandled your personal information, tell our Privacy Officer. Use the email address on this page and put Privacy complaint in the subject line.
  2. We acknowledge every complaint, investigate it, and tell you in writing what we found and what we did about it.
  3. If you are not satisfied with our answer, you can complain to the Office of the Privacy Commissioner of Canada, at www.priv.gc.ca.

11. Changes to this policy

We may update this policy. The version on this page is the current one, and the date it was last revised is shown below. If we change it in a way that materially affects how we handle information we already hold about you, we will take reasonable steps to tell you rather than relying on you noticing the change here.
