What this page covers

These terms cover this website: what it is for, what you may do with it, and what we do and do not promise about it.

They are not the terms on which we carry freight. Those are on our conditions of carriage, and they are the ones that decide what happens if a shipment is damaged.

1. Who these terms are for

  1. This website is aimed at businesses that ship freight. It is not a consumer service, and these terms are written for a business user.
  2. By using the site you accept these terms. If you do not accept them, do not use the site.

2. What this website is, and what it is not

  1. The site describes our services, lets you ask us for a price, and lets you look up the status of a shipment.
  2. Sending a quote request does not book a shipment. It is a request for a price. It does not reserve equipment or capacity, and it does not create a contract of carriage.
  3. Nothing on this website is an offer capable of being accepted so as to form a contract of carriage. A contract of carriage is formed when we take possession of freight and issue a bill of lading for it, as set out in our conditions of carriage.

3. Rates, transit times and quote requests

  1. Any rate or transit time shown on this site or sent in response to a quote request is indicative and is subject to confirmation.
  2. A quotation assumes the freight matches what you described. If the pieces, weight, dimensions or commodity differ, the price changes.
  3. A transit time is an estimate and not a guarantee.
  4. You are responsible for the accuracy of everything you enter into a form on this site.

4. Tracking information

  1. Shipment status shown on this site is provided for convenience. It can lag behind what is actually happening on the road.
  2. The signed delivery receipt, not the website, is the record of what was delivered and in what condition.

5. Acceptable use

When you use this site, you agree not to:

  • give us false information, or use someone else's identity or account
  • scrape, harvest or bulk copy the site, or use an automated tool against it beyond ordinary search engine crawling
  • try to get access to any part of the site, a system or an account you are not authorized to reach
  • interfere with the site, overload it, or introduce anything malicious to it
  • use anything obtained here to send unsolicited commercial messages
  • use the site for anything unlawful

We may suspend or refuse access to anyone who does any of these things.

6. Accounts and logins

  1. If we issue you a login to a customer portal, you are responsible for keeping the credentials secure and for what is done with them.
  2. Tell us immediately if you think a credential has been compromised.
  3. Do not share a login. If more people need access, ask us for more logins.

7. Content and intellectual property

  1. The text, images, layout and code of this site belong to us or to our licensors.
  2. You may read the site, print a page for your own business records, and share a link to it. You may not republish, sell or redistribute the content, or present it as your own.
  3. The KHLOELTL name and logo are ours. Do not use them without our written permission.

9. Availability and changes

  1. We do not promise that the site will always be available or free of faults. We take it down for maintenance, and things break.
  2. We may change, suspend or withdraw any part of the site at any time.

10. Our liability for this website

  1. The site is provided as it is. To the extent the law allows, we exclude implied warranties about the site and about the accuracy or completeness of the information on it.
  2. To the extent the law allows, we are not liable for indirect or consequential loss arising out of your use of this site, including lost profit and lost business.
  3. This clause is about the website only. Our liability as a carrier for loss of or damage to freight is dealt with in our conditions of carriage, and nothing on this page reduces a right you have under Ontario Regulation 643/05.
  4. Nothing in these terms excludes liability that cannot be excluded by law.

11. Privacy

What we do with personal information is set out in our privacy policy, and the cookies this site sets are listed on our cookies and analytics page.

12. Governing law and changes to these terms

  1. These terms are governed by the law of Ontario and the laws of Canada applicable in Ontario, and the courts of Ontario have jurisdiction over any dispute about them.
  2. We may change these terms. The version on this page when you use the site is the version that applies to that use.
  3. If a clause of these terms is unenforceable, the rest of them continue to apply.

Write to us by email or by post. Email reaches us fastest. If your message is about a specific shipment, quote the waybill number so we can find it.
